Who Can Apply for a Partner Visa?

You can apply for a partner visa if you are in a genuine and continuing relationship with an:

  • Australian citizen

  • Australian permanent resident

  • Eligible New Zealand citizen

Your relationship may be:

  • Legally married

  • In a de facto relationship (including same-sex) for at least 12 months

  • Based on an upcoming marriage, supported by a prospective marriage visa

To apply, you must meet certain immi rules, including character and health checks, and provide strong relationship evidence like shared finances, joint housing, travel history and social proof.

Types of Partner Visas We Help With

Onshore Partner Visa (Subclass 820 and 801)

This is for applicants who are already in Australia and wish to stay with their partner. It includes a two-stage process that starts with a temporary visa (subclass 820), followed by a permanent visa (subclass 801).

Offshore Partner Visa (Subclass 309 and 100)

This visa is for applicants outside Australia who want to join their partner. Like the onshore visa, it involves two stages: the temporary subclass309 and the permanent subclass 100.

Prospective Marriage Visa (Subclass 300)

This is for individuals engaged to an Australian citizen or permanent resident. It allows you to enter Australia, get married within 9 months, and then apply for a partner visa.

Visa Processing Times and What to Expect

Most partner visas follow a two-step process:

  • Temporary Partner Visa – allows you to live, study and work in Australia

  • Permanent Partner Visa – assessed 2 years after the initial application

During this time, onshore applicants may be eligible for a bridging visa with work rights. Offshore applicants must wait outside Australia unless otherwise advised. Processing times may vary, but we make sure your application is complete and fully compliant with visa conditions and immi rules.
